Welcome to SymFlow.ai (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our website, platform, and services (collectively, the “Services”). By using the Services, you agree to these Terms.

1. Services Provided

SymFlow.ai provides automation tools for businesses, including voice calls, SMS messaging, email automations, accounts receivable workflows, and related integrations. We are an Israel-based company serving clients globally, including the United States.

2. Client Responsibilities & Compliance

Clients using SymFlow.ai represent and warrant that they have obtained and will maintain all necessary consents and permissions from their customers before initiating calls, SMS messages, or emails through our platform. The Client is solely responsible for ensuring that all communications comply with applicable laws and regulations, including but not limited to:

  • The U.S. Telephone Consumer Protection Act (TCPA), Federal Communications Commission (FCC) rules, and state-specific disclosure or recording laws.
  • The CAN-SPAM Act, CTIA guidelines, and Do Not Call (DNC) Registry requirements.
  • All consent, opt-out, and privacy requirements applicable in each recipient’s jurisdiction.

Where required by law, the Client must ensure that call scripts or automated voice interactions include appropriate disclosures such as:

  1. “This is an AI assistant calling from [Company Name].”
  2. “This call is being recorded for quality and training purposes.”

SymFlow.ai executes communications strictly according to the Client’s instructions and does not assume legal responsibility for message content, call scripts, timing, or compliance with local or national regulations.

3. Phone Calls

  • Calls must follow applicable laws and calling-time restrictions (e.g., U.S.: 8 a.m.–9 p.m. local time).
  • Do not use prerecorded messages or autodialers without proper consent.
  • Respect the National Do Not Call Registry and internal do-not-call requests.
  • Where required, callers must clearly identify the business and provide any mandatory AI or recording disclosures before proceeding.

4. SMS Messaging

When using SMS functionality, you agree to:

  • Obtain prior express consent from recipients before sending messages.
  • Identify your business as the sender in each message.
  • Include opt-out instructions: “Reply STOP to unsubscribe. Reply HELP for help.”
  • Disclose that message frequency may vary and that standard message/data rates may apply.
  • Honor all opt-out requests immediately.

5. Email Communications

Clients using SymFlow.ai to send emails are responsible for compliance with all applicable email marketing and anti-spam laws, including but not limited to the CAN-SPAM Act (U.S.) and similar international regulations. You agree to:

  • Send emails only to recipients who have provided valid consent or a business relationship.
  • Include a clear and visible unsubscribe link in every email.
  • Identify your business as the sender and include a valid physical mailing address.
  • Honor all unsubscribe requests without delay.

6. Acceptable Use

You may not use the Services to send unlawful, harmful, fraudulent, or abusive communications, or otherwise violate applicable laws and carrier policies.

7. Limitation of Liability

SymFlow.ai is not responsible for fines, penalties, damages, or losses arising from your misuse of the Services or failure to comply with applicable laws. Our liability is limited to the fees you paid for the Services in the twelve (12) months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the State of Israel, with jurisdiction in the competent courts of Tel Aviv. Clients are responsible for compliance with laws applicable to their communications in recipient jurisdictions (e.g., TCPA/CTIA in the U.S.).
